The NDIS is built on your rights
The NDIS was designed around the UN Convention on the Rights of Persons with Disabilities. This means it's grounded in the idea that people with disability have the same human rights as everyone else — including the right to make decisions about their own lives.
Your key rights as an NDIS participant
The right to choice and control
You choose your providers. You choose your support workers. You choose how, when and where your supports are delivered. No one can make these decisions for you without your agreement — unless you have a legally appointed decision-maker.
The right to a support plan that reflects your goals
Your NDIS plan should be built around your goals — what matters to you, not what's easiest for the system. If your plan doesn't reflect what was discussed in your planning meeting, you can request a review.
The right to privacy and confidentiality
Your personal information can only be shared with your consent, except in limited circumstances (such as serious safety concerns). Providers must handle your information in accordance with the Privacy Act.
The right to make a complaint — without consequence
You have the right to complain about a provider at any time. A provider cannot reduce, change or stop your services because you made a complaint. Retaliation is a serious breach of the NDIS Code of Conduct.
The right to be treated with dignity and respect
All workers delivering NDIS supports are bound by the NDIS Code of Conduct. This requires them to act with honesty, transparency and respect — and to prioritise your safety, health and wellbeing.
The right to an advocate
You can have a disability advocate support you at any stage of the NDIS process. Advocacy services are free and independent. Your advocate can attend meetings with you, help you understand your rights and support you to resolve disputes.
